Financial settlement on divorce

We provide clear and realistic advice on the financial implications of divorce, guiding you through your options and likely outcomes. Our approach is constructive and forward-looking, helping to preserve respectful relationships while securing a settlement tailored to your needs. Wherever possible, we encourage cooperation, but if court proceedings are necessary, we have the expertise to represent you with confidence.

Child arrangements

Separation and divorce can be especially difficult when children are involved, with key concerns including living arrangements, time with each parent, and important decisions about their upbringing. The child’s welfare is always the paramount consideration, and families are encouraged to prioritise stable, workable arrangements that support children through the challenges of family breakdown. However, if family court intervention is required, we are here to support and guide you through every step.

The Divorce Process in England & Wales

The legal process typically follows these stages:

  1. Application: One or both spouses can apply for divorce by submitting Form D8 with the current court fee (£612). The application states that the marriage has irretrievably broken down.
  2. Acknowledgment of Service: The application is sent to the other spouse, who confirms receipt and acknowledgment.
  3. Conditional Order: After the 20-week reflection period, either party may apply for a conditional order, confirming the court’s approval for the divorce to proceed.
  4. Final Order: Six weeks and one day later, either spouse can apply for the final order, which legally ends the marriage.

Throughout this process, we provide advice on financial settlements, child arrangements, and related issues to ensure your interests are protected.

The Role of Divorce Solicitors

Our solicitors can support you in a number of ways:

Expert Guidance: Clear advice on your rights, options, and the implications for finances and children.
Financial Settlements: Assistance with asset division, pension sharing, and spousal maintenance.
Child Arrangements: Support in reaching agreements on living arrangements and parenting time.

Key Considerations

Uncontested Divorce: Even if both parties agree, legal advice is recommended to ensure all details are properly addressed.
Costs: Court fees are fixed, but solicitor fees vary depending on case complexity. Many firms also offer fixed-fee divorce packages.
Timescales: Under the current no-fault divorce system, including the mandatory 20-week reflection period, the process generally takes at least six months.
