The Divorce Process in England & Wales

The legal process typically follows these stages:

  1. Application: One or both spouses can apply for divorce by submitting Form D8 with the current court fee (£612). The application states that the marriage has irretrievably broken down.
  2. Acknowledgment of Service: The application is sent to the other spouse, who confirms receipt and acknowledgment.
  3. Conditional Order: After the 20-week reflection period, either party may apply for a conditional order, confirming the court’s approval for the divorce to proceed.
  4. Final Order: Six weeks and one day later, either spouse can apply for the final order, which legally ends the marriage.
